Your Privacy is Important to Us

At FORMDOCTOR and MT3 Marketing LLC (collectively “FORMDOCTOR”), our members are number one.  For that reason, all of our decisions are geared towards our members being satisfied with their experience, including how FORMDOCTOR gets and uses your personal information.

With that in mind, our Privacy policy below has been drafted as clear and straightforward as reasonably possible.  It is our goal for our members to be notified and have the opportunity to make an educated decision with respect to their privacy on FormDoctor. 

Introduction

The mission of FormDoctor is to simplify patient intake management and allow medical staff to focus on the care of its patients, rather than paper work.  Our registered users (“Members”) provide personal and personal medical information on template or custom doctor intake forms which are stored on HIPAA compliant servers. The forms can be modified, printed, or exported to integrate with a doctor’s practice management software. 

Maintaining your trust is our top priority, so we adhere to the following principles to protect your privacy:

We protect your personal information and will only provide it to third parties: (1) with your consent; (2) where it is necessary to carry out your instructions; (3) as reasonably necessary in order to provide our features and functionality to you; (4) when we reasonably believe it is required by law, subpoena or other legal process; or (5) as necessary to enforce our Terms of Service or protect the rights, property, or safety of FormDoctor, its Members and the public.

  • We have implemented appropriate security safeguards designed to protect your information in accordance with industry standards.

This Privacy Policy applies to FormDoctor.com and the FormDoctor mobile application and all other FormDoctor websites, apps, and other products and services (collectively “FormDoctor” or the “Services”). We may modify this Privacy Policy from time to time, and if we make material changes to it, we will provide notice through our Service, or by other means so that you may review the changes before you continue to use FormDoctor. If you object to any changes, you may close your account. Continuing to use FormDoctor after we publish or communicate a notice about any changes to this Privacy Policy means that you are consenting to the changes.

  1. What information do we collect? 
  • Data Controllers

Wherever you may reside, the personal information provided to or gathered by FormDoctor is controlled by FormDoctor.  If you have any concern about providing information to us or having such information stored on the servers used by FormDoctor services or otherwise used in any manner permitted in this Privacy Policy and the Terms of Service (together also referred to as FormDoctor’s Terms of Service), you should not become a Member of FormDoctor, visit our websites, apps or otherwise use our Services. If you have already registered, you can close your account here. We collect your personal information in the following ways:

  • Registration

To create an account on FormDoctor, you must provide us with at least your name, email address and/or mobile number, and a password. You can choose to provide further information about yourself during the registration process (for example, your gender and location). You understand that, by creating an account, FormDoctor and others will be able to identify you by your FormDoctor profile, and you allow FormDoctor to use this information in accordance with this Privacy Policy and our Terms of Service. We may also ask for your credit card details if you purchase the FormDoctor services.  

  • Customer Service

When you contact our customer support services, we collect information that helps us categorize your question, respond to it, and, if applicable, investigate any breach of our Terms of Service or this Privacy Policy. We also use this information to track potential problems and trends and customize our support responses to better serve you.

  • Using the FormDoctor Sites and Applications

We collect information when you use purchase or sign up for a free trial on the FormDoctor website, applications (for example, FormDoctor for iPhone or Android), other Services. If you are logged in on FormDoctor.com, or another Service or a FormDoctor cookie on your device identifies you, your usage information and the log data such as your IP address, will be associated with your account. Even if you’re not logged into a Service, we log information about devices used to access our Services, including IP address.

  • Cookies

We use cookies and similar technologies, including mobile application identifiers, to help us recognize you across different Services, security, measure use and effectiveness of our Services, and serve advertising. You can control cookies through your browser settings and other tools. By visiting FormDoctor, you consent to the placement of cookies in your browser and HTML-based emails in accordance with this Privacy Policy and FormDoctor’s Cookie Policy.

  • Other

We are always seeking to improve the services we offer you. We often introduce new features, some of which may result in the collection of new information. Furthermore, new partnerships or corporate acquisitions may result in new features, and we may potentially collect new types of information.

  1. How We Use Your Personal Information

At FormDoctor, we take pride in our motto of “Members first,” which means that above all else we strive to use your information to provide you world-class services in a professional and trustworthy manner.

  • Consent to FormDoctor Processing Information About You

By providing personal information to us when you create or update your account and profile, you are expressly and voluntarily accepting the terms and conditions of FormDoctor’s Terms of Service and freely accepting and agreeing to our processing of your personal information in ways set out by this Privacy Policy. Supplying to us any information deemed “sensitive” by applicable law is entirely voluntary on your part. You have the right to withdraw or modify your consent to FormDoctor’s collection and processing of the information you provide at any time, in accordance with the terms of this Privacy Policy and the Terms of Service, by changing your account settings, or by closing your respective account.

  • FormDoctor Communications

We communicate with you through email, notices posted on the FormDoctor websites or apps, messages to your FormDoctor inbox, and other means available through the Services, including mobile text messages and push notifications. Examples of these communications include: (1) welcome and engagement communications – informing you about how to best use FormDoctor, new features. These messages will be sent to you based on your profile information and messaging preferences. You may change your email and contact preferences at any time by signing into your account and changing your email settings. Please be aware that you cannot opt out of receiving service messages from FormDoctor.

  • Sharing Information with Affiliates

We may share your personal information with our FormDoctor affiliates (meaning entities controlled by, controlling or under common control with FormDoctor) outside of the FormDoctor entity that is your data controller (for example, FormDoctor may share your information with other FormDoctor operating entities) as necessary to provide the Services. By agreeing to this Privacy Policy, you are consenting to this sharing.

  • Compliance with Legal Process and Other Disclosures

It is possible that we may need to disclose personal information, profile information, or information about your activities as a Member or Visitor when required by law, subpoena, or other legal process, or if FormDoctor has a good faith belief that disclosure is reasonably necessary to (1) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (2) enforce the Terms of Service, investigate and defend ourselves against any third-party claims or allegations, or protect the security or integrity of our Service; or (3) exercise or protect the rights, property, or safety of FormDoctor, our Members, personnel, or others. We attempt to notify Members about legal demands for their data when appropriate in our judgment, unless     prohibited by law or court order or when the request is an emergency. In light of our principles, we may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague or lack proper authority, but do not commit to challenge every demand.

  • Disclosures to Others as the Result of a Change in Control or Sale of FormDoctor

We may also disclose your personal information to a third party as part of a sale of the assets of FormDoctor, a subsidiary, or division, or as the result of a change in control of the company or one of its affiliates, or in preparation for any of these events. Any third party to which FormDoctor transfers or sells FormDoctor’s assets will have the right to continue to use the personal and other Information that you provide to us in the manner set out in this Privacy Policy.

  • Service Providers

We may employ third party companies and individuals to facilitate our Services (e.g. maintenance, analysis, audit, marketing and development). These third parties have limited access to your information only to perform these tasks on our behalf and are obligated to FormDoctor not to disclose or use it for other purposes.

  1. Your Choices & Obligations
    • Rights to Access, Correct, or Delete Your Information, and Closing Your Account

You have a right to (1) access, modify, correct, or delete your personal information controlled by FormDoctor regarding you, (2) change or remove your content, and (3) close your account. If you close your account(s), your information will generally be removed from the Service within 72            hours.    We generally delete closed account information within 30 days of account closure.

  • Data Retention

We retain the personal information you provide while your account is in existence or as needed to provide you services. FormDoctor may retain your personal information even after you have closed your account if retention is reasonably necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes between Members, prevent fraud and abuse, or enforce this Privacy Policy and our Term of Service. We may retain personal information, for a limited period of time, if requested by law enforcement. FormDoctor’s Customer Service may retain information for as long as is necessary to provide support-related reporting and trend analysis only, but we generally delete or de-personalize closed account data, except in the case of our plugin impression data, which we will try to de-personalize at the time of collection, but in any event, we will de-personalize within 7 days.

  • Your Obligations

You must, at all times, abide by the terms and conditions of the current Privacy Policy, Terms of Service, and other policies of FormDoctor.

You must keep your username and password confidential and not share it with others.

Any violation of these guidelines or those detailed in our Terms of Service or elsewhere may lead to the restriction, suspension, or termination of your account at the sole discretion of FormDoctor.

  • Privacy Policy Complaints

If you have questions or concerns regarding this Policy, you should contact FormDoctor.  Any questions, concerns, or complaints should include the name of company or person, the alleged privacy violation, your contact information, and whether you would like the particulars of your complaint shared with the company.

                  4.3           Changes to this Privacy Policy

We may change this Privacy Policy from time to time. If we make   significant changes in the way we treat your personal information, or to the Privacy Policy, we will provide notice to you on the Services or by some other means, such as email. Please review the changes carefully. If you agree to the changes, simply continue to use our Services. If you object to any of the changes to our terms and you no longer wish to use FormDoctor, you may close your account(s). Unless stated otherwise, our current Privacy Policy applies to all information that FormDoctor has about you and your account. Using FormDoctor after a notice of changes has been communicated to you or published on our Services shall constitute consent to the changed terms or practices.

  • Security

Access to your data on FormDoctor is password-protected, and sensitive data (such as credit card information) is protected by SSL encryption when it is exchanged between your web browser and the FormDoctor Services. We also offer secure https access to the FormDoctor.com website. To protect any data you store on our servers, we also regularly monitor our system for possible vulnerabilities and attacks, and we use a tier-one secured-access data center. However, since the Internet is not a 100% secure environment, we cannot ensure or warrant the security of any information that you transmit to FormDoctor. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please help keep your account safe by using a strong password.
